Article 83. The people’s governments above the county level tourism authorities and relevant departments shall implement the tourism market supervision and management in accordance with the law and other relevant laws and regulations in their respective duties and scope of power.

The people’s governments above the county level shall organize tourism authorities, the competent departments and industrial and commercial administration, product quality supervision, transportation and other law enforcement agencies to supervise and inspect the behaviors of the relevant tour operators.

Article 84. The tourism authorities performing the regulatory functions charged to the supervision and management of objects in violation of laws, administrative regulations.

Tourism authorities and their staffs shall not participate in any form of tourism business activities.

Article 85. Tourism authorities of people’s government above the county level have the right to conduct supervision and inspection on the following matters:

(A) Business travel agency business as well as tour guides, the leader licensing;

(B) The conduct of operations of travel agents;

(C) Service behaviors of tourism practitioners such as tour guides and tour escorts;

(D) Other matters stipulated by laws and regulations.

Tourism authorities have to right to conduct supervision and inspection in accordance with the provisions of the preceding paragraph, can consult and copy the alleged illegal contract, notes, books and other information.

Article 86. Where tourism authorities and relevant departments perform the supervision and inspection in accordance with the law, the number of supervision and inspection personnel shall not be less than two and shall show legal documents. In case the number of supervision and inspection personnel is less than two or legal documents have not been shown, units and individuals to be checked have the right to refuse the supervision and inspection.

Business secrets and personal information obtained in the supervision and inspection by the supervision and inspection personnel shall be kept confidential.

Article 87. In respect of supervision and inspection in accordance with the law, the relevant units and individuals shall cooperate truthfully and explain the situation and provide the documents, data, and shall refuse or obstruct or conceal.

Article 88. In case people’s government at or above the county level tourism authorities and relevant departments identify acts violating this Law in carrying out supervision and inspection duties or processing reports, complaints, the violation shall be dealt with in a timely manner; In case the matter is under supervision of other department, the event should be timely handed over to the relevant departments for investigation with written notice.

Article 89. Local people’s governments at or above the county level shall establish tourism offenses information sharing mechanisms, and provide assistance and facilitation needed for cross-sectoral, cross-regional joint investigation of the offense.

Tourism authorities and relevant departments should open the supervision and inspection results to the public in accordance with their respective responsibilities in a timely manner.

Article 90. Travel industry organizations established in accordance with the laws, administrative regulations and the Articles of Association, shall develop the industry operating specifications and service standards, and implement self-management over the members’ conduct of operations and quality of service and organize professional ethics education and professional training to improve the capabilities of employees.
